Council Passes Ordinance to Limit Secondary Recyclers Staff | 05-May-2008
The City of Mesquite City Council has approved an ordinance regulating secondary recyclers. The ordinance is set to help combat the problem with thieves stealing metal from City and other public and private facilities.
The ordinance requires identifying information to be collected from people selling materials. It would include digital photographs of the seller and a signed statement affirming a legal right of ownership to the material. In addition, secondary metal recyclers could only purchase materials between the hours of 7 a.m. to 7 p.m. from persons who are not intoxicated and arrive in a motor vehicle. It also prohibits cash transactions.
The ordinance also prohibits the purchase of certain items without obtaining proof of ownership. Those items include:
Manhole Covers
Guardrails
Railroad Equipment
Historical Markers
Grave Markers
Air Conditioning Coils
Street Signs
Other similar items unlikely to be owned and marketed by a private individual.
Violation of the ordinance would be considered a Class C Misdemeanor and punishable by a fine of up to $500 for each offense.
